TOPO Motorsports – Terms of Service

By purchasing products from TOPO Motorsports, LLC (“we,” “us,” or “our”), you agree to the following Terms of Service. These terms apply to all orders placed through our website or events and cover key aspects of your rights and responsibilities as a customer.

1. Product Sales and Acceptance of Terms

By placing an order with TOPO Motorsports, you agree to be bound by these Terms of Service. Any additional or conflicting terms from buyers (including purchase orders or emails) are expressly rejected unless agreed to in writing.

2. Warranty and Limitations

We stand behind our craftsmanship, and warrant that any TOPO-manufactured product will match the description and specifications at the time of shipment. This limited express warranty does not apply to:

Custom work done to your specifications
Third-party components we include in assemblies
Damage caused by misuse or improper installation

We expressly disclaim all implied warranties, including merchantability and fitness for a particular purpose. Oral statements from staff or sales reps do not override these written terms.

3. Limitations of Liability

Our total liability under any purchase shall not exceed the purchase price of the item. We are not liable for:

Loss of profits
Downtime or interruptions
Damage caused by misuse, poor installation, or third-party handling

You agree to indemnify and hold TOPO Motorsports harmless for claims involving misuse or improper operation of our products.

4. Risk, Shipment & Delivery

All goods ship F.O.B. Amarillo, Texas — risk of loss passes to you once we hand your order to the carrier.
Delivery times are estimates only. We are not liable for delays caused by shipping carriers, supply chain issues, or force majeure events.
Larger items like cages, racks, or roofs may ship via freight. You must inspect shipments upon arrival and report damage immediately.

5. Pricing, Taxes & Payments

Prices are subject to change at any time without notice.
Buyer is responsible for all applicable taxes and fees unless a valid exemption is provided.
Payment is due in U.S. dollars at the time of order unless otherwise agreed in writing.

6. Returns & Cancellations

See our Return Policy for specific rules on refunds, restocking fees, and eligible items. Custom products are not returnable.

Orders may be canceled only with written approval from TOPO Motorsports.

7. In-Person Services and Shop Work

Services performed at our physical location in Amarillo, TX — including maintenance, welding, fabrication, diagnostics, and repairs — are governed by a separate agreement. These terms are outlined in a Service Authorization Form provided during drop-off.

Please ask our staff for a copy of this policy if you’re booking or receiving work in person.

8. Safety, Risk, and Use Assumption

By purchasing from TOPO Motorsports, you affirm that:

You are over 18 years of age (or a parent/guardian purchasing for a minor)
You understand the use of UTVs, ATVs, and similar off-road vehicles carries inherent risk
You voluntarily assume all risks of injury, property damage, or loss related to the use of our products
You release TOPO Motorsports from all liability arising from use of our products, including activities by your child or dependents

9. Legal Jurisdiction

These terms are governed by the laws of the State of Texas. All disputes must be resolved in Bexar County, Texas.
